These terms cover your use of this website. Consulting and contract engagements are governed by the separate written agreement we sign with you.

Acceptance

This website is operated by Talogen Systems LLC (“Talogen,” “we,” “us”). By using it, you agree to these Terms of Use and to our Privacy Policy. If you don’t agree, please don’t use the site. If you use the site on behalf of an organization, you confirm you are authorized to accept these terms for it.

Our services

The site describes our cloud migration, infrastructure-as-code, DevSecOps, audit and cloud administration services for general information. Nothing on it is an offer, a guarantee of results, or professional advice for your specific situation. Any engagement — including scope, fees, deliverables, warranties, confidentiality and liability — is governed solely by a master services agreement, statement of work, or contract agreement signed by both parties. If those documents conflict with these terms, those documents control.

Figures shown on the site, including the illustrative “delivery telemetry” panel, are representative examples and not a promise of the outcome of any particular engagement.

Using the site

You agree not to:

  • Use the site in violation of any law or regulation.
  • Attempt to gain unauthorized access to the site, its hosting infrastructure, or any related system, or probe, scan or test their vulnerability without our written permission.
  • Interfere with the site’s operation, including by overloading it or introducing malware.
  • Submit false information, impersonate anyone, or send unsolicited bulk messages through our contact form.
  • Scrape or harvest content or contact details from the site by automated means.

Security research. If you believe you have found a vulnerability, please report it to [email protected] and give us reasonable time to fix it before disclosing it. We won’t pursue good-faith researchers who follow this approach and apaper harm to users and data.

Intellectual property

The site’s content, design, logos and the Talogen name are owned by or licensed to Talogen Systems LLC and are protected by intellectual property laws. You may view and print pages for your own internal, non-commercial use, such as evaluating our services. You may not otherwise copy, modify, distribute or create derivative works from them without our written permission. Third-party names and trademarks (for example, cloud provider names) belong to their owners and are used only to describe the technologies we work with; their use does not imply endorsement.

What you send us

When you contact us, you confirm that the information you provide is accurate and that you have the right to share it. Please don’t send confidential or sensitive information, such as credentials or production data, through the contact form or unsolicited email; we will set up an appropriate secure channel once we have an agreement in place. Information you send is handled under our Privacy Policy. Sending us an enquiry doesn’t create a client relationship or any confidentiality obligation until we sign an agreement.

The site links to third-party websites for convenience. We don’t control and are not responsible for their content, availability or practices.

Disclaimers

We work to keep the site accurate and available, but it is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement, and we don’t warrant that the site will be uninterrupted or error-free.

Limitation of liability

To the fullest extent permitted by law, Talogen Systems LLC will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data, arising from your use of or inability to use the site. Our total liability for any claim relating to the site is limited to one hundred U.S. dollars (US$100). Some jurisdictions don’t allow certain limitations, so some of these may not apply to you. This section does not limit liability under any signed engagement agreement, which sets its own terms.

Indemnity

You agree to indemnify and hold harmless Talogen Systems LLC and its members, employees and contractors from claims, losses and expenses (including reasonable attorneys’ fees) arising from your breach of these terms or misuse of the site.

Governing law

These terms are governed by the laws of the TODO — STATE OF FORMATION, without regard to its conflict-of-laws rules. Any dispute relating to the site will be brought exclusively in the state or federal courts located in the TODO — STATE OF FORMATION, and you consent to their jurisdiction.

General

  • Changes. We may update these terms. The “Last updated” date shows the current version; continuing to use the site after a change means you accept it.
  • Severability. If any provision is found unenforceable, the rest remain in effect.
  • No waiver. Not enforcing a provision isn’t a waiver of our right to do so later.
  • Entire agreement. These terms and the Privacy Policy are the entire agreement about your use of the site.
